Section 27 (b) (ii) and 27 (b) - Conviction under - Challenged in the present petition
The judgment of conviction does not require an interference while exercising revisional jurisdiction as there is no procedural lapse and no misleading of evidence by convicting the petitioner - The huge quantity of drugs which were recovered sealed and sent for analysis show that there were drugs of sub standard quality apart from drugs recovery of powder from the accused show that they were also engaged in manufacturing process of sub Standard drugs. The accused were not having a licence to store the drugs—it will be just and appropriate to reduce the sentence to already undergone by the petitioner. As he has undergone about 10 months in custody out of two years, the sentence is reduced to already undergone.
